Privacy Policy

The Elma Electronic Romania SRL ("Elma") takes the obligation of data protection very seriously and designs its website, in such a way that personal data is only to the extent necessary, collected, processed and used. Under no circumstances shall personal data be leased or sold to third parties for advertising purposes. No personal data shall be used for advertising or marketing purposes without the express consent of the visitor.

On the part of Elma, access to personal data is only granted to individuals, who require this data, in order to carry out their duties on behalf of Elma, in its capacity as the controller, who are informed about the applicable statutory provisions on data protection and who have moreover committed themselves to comply with the applicable statutory provisions (Art. 5 of the EU-General Data Protection Regulation (EU-GDPR)). The collection, processing, use and transmission of the collected personal data is effected pursuant to Art. 6. (1) of the EU General Data Protection Regulation (EU GDPR), only to the extent necessary for the execution of a contractual relationship between Elma as the controller and the visitor as the data subject.

Amendments to the purpose of the processing and data usage

On account of the fact that due to technical progress and organisational changes, the deployed processing methods can change/further develop, we reserve the right to further develop this data protection statement pursuant to the new technical framework conditions. We therefore request you to check on the data protection statement of Elma, from time to time. Insofar as you do not agree with the further developments occurring over time, you may, in writing, pursuant to Article 17 of the EU General Data Protection Regulation (EU-GDPR), demand for the deletion of data, which is not stored on the basis of other statutory provisions, such as commercial or fiscal retention requirements.

Anonymous data collection

You can in principle always visit the website of the controller, without disclosing to us who you are. We only get to know the name of your internet service provider, the website from which you have accessed our website and the webpages you visit on our website. This information is analysed for statistical purposes. You remain anonymous as an individual user.

Collection and processing of personal data

Personal data is only collected, insofar as you voluntarily disclose it to us, for example, for the purposes of the newsletter registration. The controller thereby complies with the provisions pursuant to Art. 5 and 6 of the EU-General Data Protection Regulation (EU-GDPR). Within the framework of the personalised services of the controller, your registration data shall only be processed subject to your granted consent for the purposes of the shipment of our newsletter or for the needs-based configuration of the offered electronic services. You reserve the right to object to the storage of your personal data at any given time. Please send in this regard an e-mail to: with the subject line "Deletion of stored data". The processing and use of your personal data is affected pursuant to the provisions of the EU-General Data Protection Regulation (EU-GDPR). 

Export and processing of data in States outside of the European Economic Area

Insofar as an export of your personal data should take place to States outside of the European Economic Area (hereinafter EEA), Elma shall ensure that the data importer shall only process this data on the basis of a level of data protection, which is equivalent to the level of data protection, which the Elma in its capacity as the controller, is in turn obliged to comply with, pursuant to the relevant provisions of the EU-General Data Protection Regulation (EU-GDPR).

In addition, as long as you are logged-on to Facebook or own a Twitter account or an Instagram account, personal data may be exported to the USA. For further explanations and possibilities to prevent this data export, please read the section "Use of Facebook Social Plugins" or respectively "Use of Twitter" or "Use of Instagram Social Plugins" of this data protection statement.

Insofar as you are logged-on to Google or own a YouTube account, personal data may be exported to the USA. For further explanations and possibilities to prevent this data export, please refer to the section "Use of YouTube Plugins".

A transmission of personal data to Google within the framework of the use of analytical programs by the controller does in contrast not take place, because your IP address is only transmitted anonymously. Please read hereto the section "Use of analytical programs" of this data protection statement.

The service providers commissioned by the controller, have their registered offices as well as operate their IT infrastructure, exclusively within the EEA. This also applies to any use of cloud-based services. The contracts concluded with the service providers comply with the data protection and data security provisions of the EU General Data Protection Regulation (EU-GDPR). Elma remains the controller of the data processing, irrespective of the involvement of external service providers.

Use and disclosure of personal data

The personal data collected within the framework of the website of the controller shall only be used without your granted consent for the purpose of the processing of the contract and the processing of your inquiries. In all other cases, your data shall only be used for advertising and market research purposes by the controller, insofar as you have previously granted your consent. Moreover, your data shall not be passed on to any third parties. You of course reserve the right to revoke your respective granted consent at any given time with effect for the future.

For your information, you shall find on our webpages, links that refer to third-party websites. As far as this is not obvious, we point out that this is an external link. The controller has no influence whatsoever on the content and design of these websites of other providers. Therefore, the guarantees of this data protection statement do not apply to external providers.

Use of cookies

The controller uses so-called "cookies" to individually design and optimise the customer's online experience and time online. A cookie is a text file that is either stored temporarily in the computer's memory ("session cookie") or stored on the hard disk ("persistent" cookie). Cookies entail e.g. information about the user's hitherto access to the respective server or respectively information about which offers have hitherto been called-up. Cookies are not used to run programs or to load viruses onto your computer. Instead, the main purpose of cookies is to provide an offer tailored to the customer and to make the use of the service as comfortable as possible. The controller uses session cookies as well as persistent cookies.

Session cookies

The controller mainly uses "session cookies", which are not stored on the hard disk of the customer and which are deleted when closing the browser. Session cookies are used for login authentication and load balancing (balancing the system load).

Persistent cookies

In addition, the controller uses "persistent cookies" to store the personal usage settings that a customer enters when using the services of the controller, thereby enabling personalisation and improvement of the service. The persistent cookies ensure that the customer finds his personal settings again when he/she visits the website of the controller again. In addition, the service providers who have been commissioned by the controller to analyse user behaviour, use persistent cookies to recognise recurring users. These services store the data transmitted by the cookie only anonymously. An assignment to the IP address of the customer is not maintained.

Avoidance of cookies
The visitor has the possibility to reject the setting of cookies at any time. This is usually done by selecting the appropriate option in the browser settings or through additional programs. For details, please refer to the help function of the browser used by the customer. Insofar as the customer decides to deactivate cookies, this may reduce the performance scope of the services and as such to a significant extent negatively impact the use of the services of the controller.

Use of analytical programs

The controller performs or respectively commissions the performance of analytics on the behaviour of its customers within the framework of the use of its service. Anonymised or pseudonymised usage profiles are thereby created for this purpose. The creation of user profiles is effected for the sole purpose of constantly improving the service of the controller. 

The controller also uses Google Analytics within the framework of the web analytics, a web analytics service provided by Google Inc. ("Google"), whereby the controller uses Google Analytics with the extension "_anonymizeIp ()". As a result, the IP addresses are processed only truncated to exclude a direct personal inference. Objection against the data collection and storage that takes place within this framework, can be raised at any given time with effect for the future.

Use of Google+

Elma also uses Google+ plugins on our website, the operator of which is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

By visiting webpages of our website, which include Google+ plugins, the customer's browser establishes a direct connection to Google's servers. Insofar as the customer now clicks on a Google+ plugin while logged-on to his/her Google or Google+ account, Google+ shall be notified that the customer has visited our website. Pursuant to the clicking on the corresponding plug-in by the customer, the corresponding content of our website can be linked to the profile created on Google and or Google+ by our customer; provided that the customer is logged-on with his/her Google and / or Google+ account during this process. Google is thus able to create a profile of our customer, which goes beyond the information disclosed by our customer to Google and / or Google+.

Use of Facebook Social Plugins

The controller uses on its website social plugins ("plugins") of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are marked with a Facebook logo. Insofar as the customer calls-up a webpage of the controller containing such a plug-in, the customer's browser establishes a direct connection to the Facebook servers. Facebook transmits the content of the plugin directly to the customer's browser and it is then incorporated from this browser into the webpage.

Through the incorporation of the plugins, Facebook receives the information that the customer has called-up the respective webpage of the controller's website. Insofar as the customer is logged-on to Facebook, Facebook can assign the customer's visit to his/her Facebook account. Insofar as the customer interacts with the plugins, for example, presses the "Like" button or leaves a comment, the corresponding information is transmitted from the customer's browser directly to Facebook and stored there. Purpose and scope of the data collection and the further processing and use of the data by Facebook as well as the relevant rights and setting options of the customer to protect his privacy can be found in the privacy policy of Facebook.Insofar as the customer does not want Facebook to collect data in the manner described above, the customer must log-off from Facebook before visiting the controller's website.

Use of Twitter

The controller uses functions of the service Twitter on its website. These features are provided by Twitter Inc., Twitter, Inc. 1355 Market St, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the "Re-Tweet" function, the websites you visit are linked to your Twitter account and shared with other users. This data is also thereby transmitted to Twitter. We point out that we as the provider of the webpages are not aware of the content of the transmitted data as well as its use by Twitter. Use of Instagram Social Plugins

The controller uses Instagram social plugins ("plugins") on its website, which are operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA ("Instagram"). The plugins are marked with an Instagram logo, for example in the form of an "Instagram camera". When you visit a webpage of our website, which entails such a plugin, your browser connects directly to the servers of Instagram. Instagram thereby transmits the content of the plugin directly to your browser and from there it is incorporated into the webpage. This information (including your IP address) is sent from your browser directly to a server of Instagram in the USA and stored there.

Insofar as you interact with the plugins, for example by clicking on the "Instagram" button, this information is likewise transmitted directly to a server of Instagram and stored there. Insofar as you do not want Instagram to directly associate the data collected about you, through your visit to our website, with your Instagram account, you shall need to log-off from Instagram before visiting our website. You can also completely prevent the loading of Instagram plugins, with add-ons for your browser, e.g. with the script blocker "NoScript" (http://noscript.net/).

Use of YouTube-Plugins

The controller uses for the incorporation of videos, among others, the provider YouTube. YouTube is operated by YouTube LLC, with the principal place of business at 901 Cherry Avenue, San Bruno, CA 94066, USA. YouTube is represented by Google Inc., with registered offices at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

The controller uses on its website plugins of the provider YouTube. When you visit a webpage of our website, which has a YouTube plug-in, a connection to the server of YouTube is established. Information about the webpage you have visited is then transmitted over this connection to the YouTube server. Insofar as you are logged-on as a member of YouTube, YouTube assigns this information to your personal user account. In the case of the use of the plugin, such as by clicking on the start button of a video, this information is likewise assigned to your user account. You can prevent this assignment by logging-off from your YouTube user account as well as from other user accounts of the companies YouTube LLC and Google Inc. and deleting the corresponding cookies from the companies, before using our website.
